Renouncing Canadian Citizenship

Most of the time, our office helps people get Canadian citizenship. However, there are some Canadians who no longer want to be Canadian for a number of reasons.

If you're thinking about giving up your Canadian citizenship, it means you don't want to have any official ties to Canada anymore. If you are accepted, you will lose all of the rights and benefits that come with being a Canadian and become a foreign citizen. If you want to travel to, visit, study, work, or live in Canada, you will have to go through the normal Canadian visa procedures. If you want to live in Canada forever, you will have to apply for Permanent Residence.

Renouncing Canadian Citizenship

How do you become a citizen of Canada?

A Canadian citizen is someone who has been given certain rights and benefits by Canada and is expected to keep certain promises to Canada in return. People can become citizens of Canada if they are born there, if they are born to Canadian parents (in some cases), if they serve in the Canadian military, or if they come to Canada as a Permanent Resident and then meet the requirements to become a citizen.

Citizens of Canada have a Canadian visa, can vote in Canadian elections, can run for political office, and can go anywhere in Canada to live, work, or study.

Why would a Canadian give up their citizenship?

Yes, it is possible that someone no longer wants to be Canadian. People decide to give up their Canadian citizenship for a variety of reasons, including political views, ideological differences, or, most often, because they want to become a citizen of another country that doesn't allow dual citizenship. If you want to become a citizen of a country other than Canada, you may have to give up your Canadian identity.

In other cases, a person who has two citizenships may want to run for political office in another country but can't because they have two citizenships. There is no mandatory military service in Canada right now, so you don't have to give up your citizenship to escape it.

Because of changes to Canada's citizenship rules in 2009 and 2015, some people who were not Canadian Citizens before became Canadian on those dates. This can be a problem for some, especially if they have never lived in Canada and are a citizen of a country that doesn't allow them to be a citizen of more than one country.

Canada doesn't tax its citizens unless they live in Canada, so giving up Canadian citizenship to avoid paying income tax isn't as common as it might be for citizens of other countries with different tax rules, like the United States.

Who can give up their citizenship in Canada?

To be able to give up your Canadian citizenship on your own, you must meet the following requirements:

you have a different foreign identity, so that if you give up your Canadian citizenship, you won't be left without a country. When you give up your Canadian citizenship, you might be a dual citizen or be able to become a citizen of another country.

you do not live in Canada.

You are at least 18 years old and can understand what it means to give up your citizenship.

You are not in trouble, like having your visa taken away, a criminal, or a threat to Canada's security.

How do I give up my citizenship in Canada?

People who want to give up their Canadian citizenship can do so in two different ways. One is for people who became Canadian citizens immediately because of changes to the Citizenship Act in 2009 or 2015. The second step is for everyone else.

In order to abandon citizenship, you have to show that you are still a Canadian citizen and that you are a citizen of a country other than Canada or will become one soon.

The application box includes a government form to fill out and copies of the necessary papers that must be included as proof. The exact documents you need to include depend on your situation, but they usually include a passport-sized photo, your birth certificate, the birth certificates of your parents, copies of your ID documents like a driver's license, documents showing a name change, and a foreign passport to show you have another citizenship. If you have an original Canadian Citizenship certificate, you will also need to send that back with the application box.

The form is hard to understand because it is meant to cover a wide range of possible scenarios. You will need to pay close attention to make sure you've filled out all of the parts that apply to you and skipped over the ones that don't.

How much does it cost to quit being a Canadian?

When you send in your application to quit, the Canadian government will charge you $100 per person. If you decide to hire a lawyer to handle your application, you will have to pay more for their help.

How long does it take to quit being a Canadian?

Usually, it takes about 14 months to process a request to give up Canadian citizenship. In some cases, you can ask for urgent handling, but there is no promise that Canada will make a decision in a certain amount of time.

When you give up your Canadian citizenship, what do you lose?

If you give up your Canadian citizenship, you lose all legal ties to Canada. This means you can't use a Canadian passport to travel, you can't be sure you'll always be allowed to enter Canada, you can't work or study in Canada, and you can't stay in Canada for as long as you want. You won't be able to vote in Canadian elections or run for political office either. Your children who were born after you decided to give up your Canadian citizenship won't be able to get it.

This means that if you give up your citizenship while you are outside of Canada and then want to come to Canada, you will need to apply for either an eTA or a temporary resident visa, based on which passport you keep after giving up your citizenship.

Can I still live in Canada if my request to quit is approved?

Once you are no longer a Canadian citizen, you have to follow the rules for foreigners who want to move to Canada. So, if you want to stay in Canada after giving up your Canadian citizenship, you will need to fill out an application form for a guest record and send it in. You can't work or go to school in Canada if you don't have the right pass.

If you gave up your Canadian citizenship, can you get it back?

You lose your legal standing in Canada when you give up your Canadian citizenship, which is an official process. The only way to fix this is to start over with Canada's immigration process, apply for Permanent Residence, become a Permanent Resident, and then stay in Canada long enough to become a Canadian citizen again. If you become a Permanent Resident of Canada and you used to be a Canadian citizen, you can apply to get your citizenship back after living in the country as a Permanent Resident for a year and making at least one income tax report.

It's important to remember that it's not easy to get Permanent Residence, and the rules change often. This means that anyone who is thinking about giving up their Canadian citizenship should be okay with the idea that they will likely lose their status for good.

Note that people whose citizenship was taken away cannot use this method to try to get it back.

What is the difference between giving up Canadian citizenship and taking it away?

Renouncing Canadian citizenship means that a person has decided they no longer want to be a Canadian citizen and has asked the Canadian government to take away their status. Revoking Canadian Citizenship means that the Canadian government has chosen that the person should no longer be a Canadian Citizen, and they are taking the status away from the person whether or not the person wants to lose it.
